1. Agreement to Terms

By downloading, installing, or using BetterSwing (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Ogodi Technologies Ltd (“we”, “us”, or “our”), a company registered in Nigeria.

2. Eligibility

You must be at least 13 years old to use BetterSwing. By using the App, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

3. Your Account

3.1 Account Registration

You must create an account to use BetterSwing. You are responsible for providing accurate information and keeping your account credentials secure.

3.2 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at contactus@ogoditechnologies.com if you suspect unauthorised access.

3.3 Account Deletion

You may delete your account at any time via Settings > Delete Account. Deletion removes your account and associated data. See our Privacy Policy for information about data retention after deletion.

4. Use of the App

4.1 Permitted Use

BetterSwing is provided for personal, non-commercial use to help golfers improve their swing technique through AI-powered video analysis and coaching feedback.

4.2 Prohibited Use

You agree not to:

• Use the App for any unlawful purpose
• Upload videos that contain content other than your own golf swing (e.g. other people without consent, inappropriate content)
• Attempt to reverse-engineer, decompile, or tamper with the App or its backend systems
• Use automated tools, bots, or scripts to access the App
• Impersonate another person or entity
• Attempt to gain unauthorised access to any part of our systems

5. Content You Upload

5.1 Your Ownership

You retain full ownership of the videos you upload to BetterSwing.

5.2 Licence to Us

By uploading a video, you grant Ogodi Technologies Ltd a limited, non-exclusive, royalty-free licence to process and analyse the video for the sole purpose of generating your coaching feedback. We do not use your videos to train AI models or share them with other users.

5.3 Your Responsibility

You are responsible for ensuring you have the right to upload any content you submit. Do not upload videos that feature other people without their consent.

6. AI-Powered Coaching — Important Disclaimer

BetterSwing uses artificial intelligence to provide swing analysis and coaching suggestions. This is not professional coaching advice.

• Coaching cues and feedback are generated automatically by AI and are intended as supplementary guidance only.
• Results may not always be accurate. AI analysis has inherent limitations and may not capture all aspects of your technique.
• BetterSwing does not replace the advice of a qualified golf professional (PGA/golf coach).
• We are not responsible for any injury, damage, or loss arising from following coaching suggestions provided by the App.
• If you have any physical injury or health condition, consult a medical professional before undertaking any physical activity.

7. Subscriptions and Payments

Subscription and payment features are not yet active in the current version of BetterSwing. When subscription features are introduced:

• Pricing, billing frequency, and plan details will be clearly disclosed before purchase
• In-app purchases are processed through the Apple App Store
• To cancel a subscription, you must manage it through your Apple ID settings (Settings > Apple ID > Subscriptions)
• Refunds are governed by Apple's App Store refund policy

We are not responsible for payments processed through the Apple App Store.

7.1 Restore Purchases

If you believe you have an active subscription that is not reflected in the App, you can restore it via Settings > Restore Purchases.

8. Intellectual Property

All content, software, training plans, coaching frameworks, and other materials within BetterSwing (excluding content you upload) are the intellectual property of Ogodi Technologies Ltd. You may not copy, distribute, or create derivative works without our express written permission.

9. Availability and Updates

We aim to keep BetterSwing available at all times but do not guarantee uninterrupted service. We may:

• Temporarily suspend the App for maintenance or updates
• Modify, add, or remove features at any time
• Discontinue the App with reasonable notice

10. Third-Party Services

BetterSwing integrates with third-party services (Clerk, Railway, Amazon S3, OpenAI, Mixpanel, Cloudflare). Your use of these services through the App is also subject to their respective terms and policies. We are not responsible for the practices of these third parties.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, BetterSwing is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or reliability of AI coaching feedback
• Fitness for a particular purpose
• Uninterrupted or error-free operation

12. Limitation of Liability

To the maximum extent permitted by Nigerian law, Ogodi Technologies Ltd shall not be liable for:

• Indirect, incidental, or consequential damages arising from your use of the App
• Loss of data, revenue, or profits
• Physical injury resulting from following coaching suggestions in the App
• Service interruptions or data loss caused by third-party infrastructure providers

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Ogodi Technologies Ltd and its officers, employees, and partners from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the App in violation of these Terms
• Content you upload to the App
• Your violation of any applicable law

14. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may stop using the App and delete your account at any time. Termination does not affect any rights or obligations accrued prior to termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from or related to these Terms shall be resolved in the courts of Nigeria.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective Date” at the top of this page. Significant changes will be notified via the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.
